The realization of the production of goods and services by the administration by staying apart from the conditions of the market is called public service. The administration makes use of various public goods while performing public services. Public goods are classified under 3 headings in the administrative law doctrine. These; unclaimed goods, common goods and service goods. Unclaimed properties are properties that are completely under the control and disposal of the administration and on which a private property relationship cannot be established. The ability of the state, which we can express as an organized area in a certain area with borders, is embodied on these goods. Communal goods, which are another category of public goods, are goods open to the use of all or a part of the public. Service goods, on the other hand, are goods allocated to a particular public service. Public property owned by the administration; They cannot be sold, transferred, expropriated, subject to tax or similar financial obligations. In addition, these goods do not need to be registered in the land registry. Public properties that cannot be acquired through statute of limitations are not subject to civil legal proceedings such as mortgages or pledges. Public goods generally do not have the opportunity to bet on foreclosures. The shores of the 1982 Constitution; It has been regulated as a social and economic right under the title of “Utilization of the coasts”. In the said article 43, “The coasts are under the authority and disposal of the State. In the utilization of sea coasts, lake shores or river banks, and of the coastal strip along the sea and lakes, public interest shall be taken into consideration with priority. The width of coasts and coastal strips according to the purpose of utilization and the conditions of utilization by individuals shall be determined by law.” Pursuant to the article, it was stated that the state related to the coasts had control and surveillance authority and various duties were imposed on the state. Similarly, in Article 5 of the Coastal Law No. 3621, which is the general regulatory norm regarding the coasts; “The general principles regarding the coasts are as follows: Coasts are under the jurisdiction and disposal of the State. The coasts are open for everyone to enjoy equally and freely. In making use of the coast and coastlines, the public interest is primarily considered.” has provisions. As it can be understood from the article, it is regulated that a profit-motivated approach such as a market area cannot be adopted by emphasizing the public interest in benefiting from the coasts. Article 6 of the aforementioned law is; “The coast is open to everyone's enjoyment of equality and freedom, and no structures can be built there; Walls, fences, fences, fences, ditches, piles and similar obstacles cannot be created. Excavations cannot be made on the coasts in a way that will change the coast; sand, gravel, etc. cannot be taken or withdrawn.” It prohibited the use of coasts in a way that excludes members of society. It is not possible to establish a relationship of belonging to any private person regarding the coasts that should be considered as unclaimed property. Therefore, it will not be legally possible for private persons to have full disposition authority on a property with coastal status. However, in this matter, which is clearly regulated by the subject law, the opposite situation is experienced in practice. In some of the coasts, private businesses under the name of "beach" exclude citizens from the coasts and do not allow them to benefit, based on the permission they have received from the relevant administrations. These businesses try to allocate these areas to certain groups, especially with the authorizations they receive from local authorities through various mechanisms. It is essential to evaluate the situation, which is a new area of conflict, in terms of administrative law. The difference between the legal provisions and the current situation reveals the theory-practice incompatibility and this contradiction is at the center of the problem. In this study, the legal status of the coasts is explained. In this context, firstly, the classification of public goods has been made and the place of the coasts in this classification has been classified. The status of private enterprises under the name of “beach” on the coasts has been evaluated and their compliance with the law has been analyzed.
