Çalışmanın amacı, her hukuka aykırılığın aynı ölçüde manevi zarara yol açıp açmadığını ve hukuka aykırı disiplin işleminin kişi üzerinde doğurduğu bağımsız manevi etkinin nasıl değerlendirilmesi gerektiğini ortaya koymaktır. Sonuç olarak hukuka aykırı disiplin cezalarından doğan manevi tazminat sorunu, Anayasa’nın 125. maddesinde ifadesini bulan idarenin zararı giderme yükümlülüğü ışığında, bireyin manevi varlığı üzerindeki gerçek etkiyi esas alan sistematik bir çerçevede değerlendirilmektedir.
Unlawful disciplinary sanctions constitute one of the prominent manifestations of the problem of nonpecuniary compensation in administrative law. The reason for this is that disciplinary sanctions may affect not only the legal status of the person concerned, but also professional reputation, position within the institution, and personal values. In administrative judicial practice, claims for nonpecuniary compensation arising from unlawful disciplinary sanctions are often interpreted narrowly, primarily on the basis of the gravity of the fault attributable to the administration. Against this approach, the study focuses on the conditions under which nonpecuniary harm should be taken into account in assessing the administration’s liability in damages. Within the study, the relationship between the judicial review of disciplinary sanctions and the full remedy actions, the nature of unlawfulness, the scope of nonpecuniary harm, causation, and the function of fault are addressed in the context of nonpecuniary compensation arising from unlawful disciplinary sanctions. The aim of the study is to set out whether every unlawfulness gives rise to nonpecuniary harm to the same extent and how the independent nonpecuniary effects produced by an unlawful disciplinary sanction on the individual should be assessed. In conclusion, the problem of nonpecuniary compensation arising from unlawful disciplinary sanctions should be assessed, in the light of the administration’s obligation to remedy damage as expressed in Article 125 of the Constitution, within a systematic framework based on the actual impact on the individual’s moral sphere.
