Rights of Passengers in the Contract of Civil Transportation with Airline

Abstract

As a result of developing technology and globallism, transportation of passengers with airline becomes more prefered because it is comfortable and economic. Especially with airline transportation of civil passengers, there may be some troubles that makes passengers suffer such as lost of the baggages, delay or cancel of the flights. It needed to organize some national and international orders to secure the rights of the airline passengers and to prevent their rights or to minimize unjust treatments against large companies. In this study, rights of passengers in the contract of civil transportation with airline will be examined according to both Turkish Civil Aviation Code and international aviation rules.

Gelişen teknoloji ve küreselleşmenin sonucunda havayolu ile yolcu taşımacılığı gerek hızlı gerek rahat ve ekonomik olması nedeniyle yoğun bir şekilde tercih edilmektedir. Özellikle sivil havayolu ile yolcu taşımacılığında karşılaşılan bagajların zıyaı ve kaybı, uçuşların iptali veya tehiri, yolcunun uçağa kabul edilmemesi gibi durumlar sonucu yolcular mağdur olmaktadır. Yolcu haklarının güvenceye alınması ve yolcuların büyük şirketlere karşı mağduriyetini engellemek yahut en aza indirgemek açısından yolcu haklarının ulusal ve uluslararası belgeler kapsamında düzenlenmesi gerekmiştir.
