Özet
This study aims to ascertain the major impediments to effective enforcement of the EU asylum policy through an analysis of Turkey-EU cooperation in this field. The course of relations with third countries and EU migration diplomacy will be examined through an in-depth analysis of up to now cooperative attempts between the EU and Turkey in the field of border management and asylum. The emphasis of new EU Pact on Immigration and Asylum on ‘comprehensive approach to asylum’ and ‘European solutions to European challenge’ has several implications on the cooperation with third countries. Lack of solidarity among EU member states in sharing the burden of asylum applications will likely to increase dependence on an old practice: outsourcing of European border management and asylum policies to third countries. This study explores the forms of diffusion of EU policies that have worked and still work for maintaining internal security and reinforcement of external borders of the EU and providing third countries with the institutional capacity particularly for fast returns and readmission. The preliminary findings of this research suggest that the extension of EU migration and asylum regime to third countries such as Turkey widens the gap between the international refugee regime and the EU refugee regime and this causes the EU to lose its image as normative international actor as it violates several principles of international refugee law and humanitarian law. In light of these preliminary findings, this research is likely to have critical policy implications for Turkey, EU and its neighbourhood with lingering repercussions in contested EU policy areas such as burden-sharing and outsourcing of border security and refugee protection.
