Constitutions are social contracts that are used to make a society live in peace, to limit
the powers of the governing body, and to guarantee fundamental rights and freedoms. The
ability of a community to live together in the light of certain common principles and values
depends on the social acceptance of these texts. While preparing constitution which are at the
top of the hierarchy of norms, the methods to bring the social consensus to the highest point
should be preferred
In this study, an ideal constitution making process is tried to be explained. In this
context, firstly, the concept of the constitution was mentioned and, the amendment method of
the constitution foreseen in the current 1982 Constitution was explained. After that; By whom
constitutions can be made, in which periods and, how they will be put into effect have been
examined from a doctrinal perspective. Finally, the methods to be followed in the process of
making a constitution are explained.
Anayasalar bir toplumun barış içerisinde yaşamasını sağlamak, yönetenin yetkilerini
sınırlandırmak, temel hak ve özgürlükleri güvence altına almak üzere kullanılan toplum
sözleşmeleridir. Bir toplumun belli ortak ilkeler ve değerler ışığında bir arada yaşayabilmesi
bu metinlerin toplumca benimsenmesine bağlıdır. Normlar hiyerarşisinin en üstünde yer alan
bu metinler hazırlanırken, toplumsal uzlaşıyı en üst noktaya çıkaracak yöntemler tercih
edilmelidir.
Bu çalışmada ideal bir anayasa yapım süreci anlatılmaya çalışılmıştır. Bu kapsamda
öncelikle anayasa kavramına değinilmiş ve mevcut 1982 Anayasasında öngörülen anayasanın
değişiklik usulü anlatılmıştır. Sonrasında; anayasaların kim tarafından, hangi dönemlerde
yapılabileceği ve nasıl yürürlüğe konulacağı doktriner açıdan incelenmiştir. Son olarak ise bir
anayasa yapım sürecinde izlenmesi gereken yöntemler anlatılmaya çalışılmıştır.
