According to article 5/1-c of SMK (Industrial Property Law); if a trademark indicates the geographical source of the goods/services to which it relates or according to article 5/1-f of SMK; If a trademark misleads the public about the geographical source of the goods or services to which it relates, it is not possible to register this trademark. In the relevant legal provisions and judicial decisions, the use of geographical place names in trademarks is not completely prohibited, but some restrictions have been imposed on their use. The circumstances in which a geographical trademark will fall within the scope of SMK article 5/1-c or 5/1-f have been shaped especially by judicial decisions. Whether or not a trademark has a registration obstacle within the scope of such provisions determined according to the perception of the relevant environment in which the goods or services to which the trademark relates will be used. If individuals of reasonable average intelligence in the relevant environment perceive that the trademark used indicates the place of production of the goods or services it relates to, then the trademark will face registration obstacles in accordance with the SMK. If; while If the trademark accurately indicates the geographical source of the goods or services to which it relates, then it is considered that there is a registration obstacle within the scope of article 5/1-c of SMK; If the trademark misleadingly indicates the geographical source of the goods or services to which it relates, then it is accepted that an obstacle exists within the scope of article 5/1-f of SMK. Although the expression geographical trademarks cover trademarks containing geographical indications in many studies, in our study we will focus only on trademarks containing geographical place names, and in which cases registration obstacles will be encountered for trademarks containing such geographical place names will be discussed in the light of judicial decisions.
