People in charge of performing the public services that the administration is obliged to provide are called public personnel. In the Civil Servants Law No. 657, 3 types of employment have been determined to perform public services. These; civil servant, contracted personnel and worker status.

By the concept of civil servant, it is meant the personnel who are "assigned to perform the primary and permanent public services carried out by the state and other public legal entities in accordance with the principles of general administration". The contracted personnel “shall comply with the principles and procedures determined by the President of the Republic in temporary jobs that are necessary for the preparation, realization, operation and operability of the important projects included in the development plan, annual program and work programs, and which require special professional knowledge and expertise, exclusively for obligatory and exceptional cases. It is used to describe the "status that is decided to be employed with a contract limited to the financial year, in the positions created within the framework of the financial year". These are public officials who are not considered workers. The worker status, on the other hand, “is the permanent workers who are employed with indefinite-term employment contracts, subject to the provisions of private law, and the employees who are employed with fixed-term employment contracts for less than six months in seasonal or campaign works or in temporary work positions in accordance with the relevant legislation in forest fire fighting services.”

The Civil Servants Law No. 657 allowed the use of exceptional civil servants in the performance of some public services and regulated the procedures related to this. Exceptional civil servants are personnel who can be appointed regardless of the examination processes in the public. In order to be appointed to this status, it is sufficient to meet the general conditions stipulated in the aforementioned law. exceptional officers; It is not subject to the provisions of the law such as appointment, examinations, advancement and degree promotion.

Access to public service is among the political rights enshrined in the 1982 Constitution. In Article 70 of the 1982 Constitution; The relevant regulation under the heading "Entry into public service" states, " Every Turk has the  right  to  enter  public  service. No  criteria  other  than  the  qualifications  for  the  office concerned  shall  be  taken  into  consideration  for  recruitment  into public service.” expressed as. As can be seen in the article, entering the public service is a right granted to all citizens of the Republic of Turkey. For this reason, employment in the public sector should be subject to objective, objective and generally accepted conditions without discrimination. Otherwise, it will not be possible to establish the principle of merit, which is one of the basic principles of the public personnel system, in a healthy way.

In this study, the concept of exceptional civil servant is explained. In this context, the types of employment in the public personnel system are defined and the characteristics of the exceptional civil servant concept and the main exceptional civil servants are listed. Emphasizing the distinguishing aspects of exceptional civil servant status from other types of employment, its place in an ideal public personnel system has been analyzed.
