Abstract:

Application of financial institution in order to meet the individual needs of the consumer and creating credit with taking into account of the interests of both sides caused the consumer loan agreements in terms of legal meaning.Financial institutions seek new searches and quests due to the failure of customers to reach the desired goals owing to insufficient financial power in service supply or in purchasing any goods by customer.It is also necessary to protect the consumer, while supporting the financially weak consumer against the bank or similar financial institution is foreseen.In this context, various legal arrangements have been made both in the world and in our country. The purpose of this study is to protect consumers who are seeking loans to meet their individual needs other than professional or commercial purposes while concluding these contracts and during the contract. It will be analyzed whether consumer loan contracts are prepared in accordance with the basic principles of consumer law and whether the consumer actively participates in these contracts. The problem in this study is that the consumer does not have enough information in the loan agreements prepared by the lending financial institution.There are grievances in consumer loans due to additional burden on the consumer, aggravating the burden of the consumer and credit costs. In this study, consumer loan contracts will be evaluated legally and problems encountered in consumer loan contracts will be examined from different aspects according to the provisions in favor of the customers.Transactions like the costs demanded separately from the original debt in consumer loans that we discussed in doctrine and encounter in practice against the consumer will be evaluated within the scope of consumer protection law.
