Abstract:Lis pendens is a state of being pending. Lis pendens is regarded as an obstacle to bring an action in the frame of Code of Civil Procedure. However Enforcement and Bankruptcy Law does not include any regulation related to lis pendens. The outcomes of lack of regulation should be analyzed. The pendency aims at providing many important principles in law of civil procedure. It should be analyzed whether the same aims are valid for the enforcement law. In this frame, it should be examined in which ways the pendency could take place between the enforcement procedures and it should be researched through which tools the pendency could be argued.
